F.U.Q: Two Buyers, One Home

Today’s Dwell Denver Difference F.U.Q.: What happens if you have another client who wants to offer on the same house I want to offer on? Has that ever happened before?

Imagine this: you and I have been working together for several months now.  We’ve seen everything there is to be seen on the market and we’re just waiting for the right house to pop up so we can get it under contract as quickly as possible.  Then, one day, I’m referred to a new buyer who is looking in your price range, for the same type of home, in the same neighborhood. I show them the same homes I’ve shown you in hopes that one of them will work.  We’re also waiting for the right house to pop up. Then it does. And you both want it. What do we do?

While this has never happened to me in my 12 years as an agent, I can absolutely see how this situation would be distressing if it did come up…for everyone involved.  Instead of insisting that our clients call “dibs” on any given house, here’s how we would handle this situation:

  1. Full disclosure and honesty to all parties.  It’s our duty as your buyer’s agent to tell you everything we know about a property and the situation surrounding an offer.  I would tell you both that I have another buyer who wants to make an offer and we’re going to plan B.

  2. Plan B, split you two up.  Not because you’re in trouble but because I don’t feel comfortable advocating for two buyers on one property. While it’s legally possible for me to write an offer for both of you, with disclosure to you both, I don’t feel that I could fulfill my fiduciary duty to both parties on the same property. One would go with Heather and one would go with me if all parties agreed to this. The benefit of me and Heather working as a team is that we can each take a buyer and fight fiercely on their behalf and not have a conflict of interest.

  3. Full disclosure recap of the situation once the sellers have chosen.  Our mission is to fiercely advocate on your behalf but ultimately, it’s the seller’s decision. We will let you know as much about the offer that was accepted as possible.

Bottom line is, we would treat our two buyers the way we’d want to be treated in this situation. The reason you chose to work with us is so that we can put all of our experience, knowledge, and negotiating skills behind getting you the best home for the best price, and for the best terms.  Nothing will stand between us and that mission!
